LOCAL RULES of a little ONLINE STORE

(Current as at 25 December 2014)

 

I. Basic Concepts

 

Seller - FX Electronics Online Store, located in Łódź Street Cegielniana 22 entered in the register of companies, VAT number: 7281056940.

Shop - a website belonging to the Seller, available under the domain fx-electronics.pl through which the customer can purchase from the Seller for the Goods.

Client - a natural person who is at least 13 years of age, and in the case of non-completion by the person 18 years of age, requires the consent of her legal representative, as well as a legal person or an organizational unit without legal personality, which confer the ability of specific provisions legal, and who makes or intends to make a request or use other services Store (including the consumer).

Consumer - a person performing a legal act (contract of sale through the Shop) not directly related to his trade or profession.

Regulations - these regulations specifying the reasonable provision of electronic services by the Seller.

Goods - the thing moving, presented in the store, which could be the subject of a contract of sale, in detail specified in the contract.

Order Form - a service available on the Store's website, through which the customer do not have a user account, you may purchase the Goods.

 

II. General Provisions

 

The Regulations define the rules for the conclusion between the Seller and the Customer contract of sale of the Goods, by means of distance communication and use by you of the Shop, available online at fx-electronics.pl.

In terms of services provided electronically these Rules is rules, referred to in Art. 9 of the Act of 18 July 2002. On the provision of electronic services (Journal of Laws of 2002. III. Acceptance and execution of orders

 

The prerequisite for using the services of the Store is acquainted with these Rules and acceptance. By placing an order the Customer accepts the Terms of Use.

Orders from customers are adopted by fx-electronics.pl and e-mail address, 7 days a week, 24 hours a day. The customer receives an order confirmation of order via e-mail correspondence.

Upon receipt of the Customer a confirmation of the offer, begin the process of execution of the contract by the Seller, whereby:

in the case of an order paid on delivery - starts up the next business day after confirmation by the Seller,
in the case of an order paid by bank transfer to the traditional - starts after the payment in your bank account Shop for your order.
Orders placed in the store are made during business hours Store (on business days, from Monday to Friday, [hours that the shop works].

Each order is issued a receipt VAT. On request, we issue a VAT invoice.

Specified in the contract price is the total price you (the Customer) will be obliged to pay  with due taxes and the cost of delivery.

If the consumer is obliged to payment beyond the agreed price, which would contain the elements specified in paragraph. 7 above, Shop inform consumer of this fact. Consumer load additional costs will be paid only after obtaining the express consent of the consumer.

 

IV. Delivery costs and delivery time

Implementation of the order in the store shipping is done through the Polish Post.

Store orders are carried out only on weekdays. Orders placed on Saturdays, Sundays and holidays are implemented first following working day.

The waiting time for delivery is [timeout]. While waiting consists = delivery time (completion of the goods to the contract) + the expected delivery time (longer than 24 hours in the case of Polish).

V. Payment

 

Within the operation of the Store you have the following methods of payment:

A customer who chose to transfer payment, is required to pay for your order within 10 working days from the date of order. VI. Complaint

The seller is liable under the warranty for physical and legal defects of the Goods to the extent specified in Art. 556 and following of the Act of 23 April 1964 - Civil Code (DZ. Laws of 2014, pos. 121)

Seller shall be liable under the warranty if physical defect is found before the expiry of two years from the date of delivery of goods to the Customer.
In the case of a consumer, the physical defect was found within one year from the date of delivery of the Goods shall be presumed that the defect or cause existed at the time the Goods.
Seller is responsible for warranty for defects of the Goods, which existed at the time of the transition to a client or danger arose from causes inherent in the thing sold at the same time.
If a product has a defect, you may make a statement on reduction in price or withdraw from the contract unless the Seller immediately replace the defective product free of defects or remove the defect. This limitation does not apply if the product has already been replaced or repaired by the Seller or Seller did not satisfy the obligation to exchange the Goods free of defects and defect removal.
If a product has a defect, you may also request a free exchange of things of defects or defect removal.
The consumer may instead proposed by the Seller to remove defects require replacement of the Goods to be free from defects or instead of replacing the Goods to request to remove a defect, unless the Goods bring into conformity with the contract in a manner chosen by the Consumer is impossible or would require excessive costs in comparison with the method proposed by the Seller.
Customer may not cancel the contract if the defect is irrelevant.
Seller agrees to respond to the complaint within 14 days of its receipt.
If the complaint is justified by the Seller will replace the defective product free of defects or rectify the defect within 14 days from the date of notification of the complaint by the Client.
In the case of an effective withdrawal Seller undertakes to return the payment within 14 days of receipt of the withdrawal, with the proviso that there will be no refund of the payment until receipt of the Goods back or deliver by the Consumer proof of its references.
The claim for the removal of defects or replacement of the Goods to be free from defects expires after one year from the date of discovery of a defect. In the case of a consumer, the limitation period can not be completed within two years.
The customer realizing the rights resulting from the warranty at the expense of the Seller will deliver the defective Goods Seller at the address specified in Section III, paragraph. 6 paragraph d of this Regulation.
 

VII. Right of withdrawal

According to the Act of 30 May 2014. The consumer rights, consumer may rescind the contract of sale of goods purchased in the store for no reason, making a statement in writing within 14 from the date of delivery of the goods (ie. Seller will refund the payment using the same method of payment, which used the consumer.
The consumer bears the cost of returning the Goods the Seller.
 

VIII. Personal data protection

 

1. When placing an order the customer consents to the processing specified by the personal data in order to implement and service contract by the Seller, who is also the administrator of personal data within the meaning of the Act of 29 August 1997 on the protection of personal data.

2. Personal data contained in the database Sellers are not communicated to those not involved in the implementation of the agreement of sale.

3. Customer in accordance with the Act on the Protection of personal data is entitled to access to their personal data, the ability to correct and remove. Seller provides each client the right to control the processing of data in accordance with Art. 32 of the Act on the Protection of

personal data.

4. The use of personal data is voluntary, but failure to consent to the processing of personal data prevents the completion of your order.

IX. Final Provisions

1. Regulations define rules conclusion and execution of the contract of sale of goods on the Store.

2. The contract of sale is concluded between the Customer and the Seller fx-electronics.pl . Fixation, protection and disclosure of relevant provisions of the contract for printing and handing the customer with the consignment documents confirming the purchase of goods.
