Online store privacy policy

1. This document specifies the rules for the processing and protection of personal data of Customers of the Online Store available at https://fx-electronics.pl/.
2. The owner of the Online Store and the administrator of personal data of Customers - natural persons - and users whose data concern is FX ELECTRONICS Jadwiga Rudnicka, NI: 7281056940, REGON: 101316328, tel. 536288802, e-mail: fx@fx-electronics.pl, hereinafter referred to as hereinafter referred to as the Administrator and being also the Seller.
3. Personal data collected by the Administrator via the Online Store are processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (OJ EU No. 119, p. 1) (General Data Protection Regulation, GDPR) and other currently applicable provisions of the law on the protection of personal data, i.e. throughout the period of processing of specific data . Personal data means information relating to an identified or identifiable natural person (hereinafter referred to as Personal Data). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, an online identifier, location data, one or more factors specific to the physical, genetic, mental, economic, cultural or social identity of an individual.
4. The Administrator takes special care to respect the privacy of customers visiting its Online Store.

§ 1 Type of data processed, purposes and legal basis

1. The Administrator collects information about natural persons performing legal transactions not directly related to their activities, natural persons conducting business or professional activities on their own behalf and natural persons representing legal persons or organizational units that are not legal persons, to which the Act grants legal capacity, conducting business activities on their own behalf. or professional, hereinafter referred to as Clients.
2. The purposes of processing Customers' Personal Data by the Administrator are in particular:
   1.  registering an account in the Online Store in order to create an individual account and manage this account. Legal basis - necessary to perform the contract for the provision of the Account service - art. 6 section 1 letter b GDPR;
   2. placing an order in the Online Store in order to execute the sales contract. Legal basis - necessary to execute the sales contract - art. 6 section 1 letter b GDPR;
   3. subscription to the Newsletter in order to perform the contract, the subject of which is a service provided electronically. Legal basis - consent of the data subject to perform the contract for the provision of the Newsletter service - art. 6 section 1 letter a GDPR.
3. When registering an account for the Newsletter service in the Online Store, the Customer provides the following data:
   1. e-mail address.
4. When placing an order in the Online Store, the Customer provides the following data:
   1. e-mail address;
   2. address details: postal code and city, country, street, house/apartment number;
   3. name and surname;
   4. telephone number.
5. Entrepreneurs provide the above data and additionally:
   1. The name of the Entrepreneur's company;
   2. NIP number.
6. When using the Newsletter service, the Customer provides the following data:
   1. e-mail address;
   2. telephone number.
7. When using the Online Store, additional information may also be collected, including: the IP address assigned to the Customer's computer or the external IP address of the Internet provider, domain, browser type, access time, operating system type.
8. Navigational data may also be collected from Customers, including information about links and references they decide to click or other activities performed in our Online Store. Legal basis - legitimate interest - art. 6 section 1 letter f GDPR, enabling better use of services provided electronically.
9. In order to determine, pursue and enforce claims, some personal data provided by the Customer as part of using the functionality may also be processed, including: name, surname, data regarding the use of services, if claims result from the way in which the Customer uses the services, other data necessary to prove the existence of the claim, including the extent of the damage suffered. Legal basis - legitimate interest - art. 6 section 1 letter f GDPR, consisting in determining, pursuing and enforcing claims and defending against claims in proceedings before courts and other state authorities.

Personal data collected by the Administrator are voluntarily provided to him in connection with concluded sales contracts or the provision of services via the Online Store, with the proviso that failure to provide the data specified in the forms in the Registration process makes it impossible to register and set up a Customer Account, and in the event of submitting ordering without Registering a Customer Account will make it impossible to place and process the order.

Who can we transfer your data to and how long it is stored

1. The catalog of recipients of Personal Data processed by the Administrator results primarily from the scope of services used by the Customer. The Customer's personal data is transferred to service providers used by the Administrator to run the Online Store. The Administrator's service providers to whom personal data are transferred, depending on contractual arrangements and circumstances, are subject to the Administrator's instructions regarding the purposes and methods of processing this data - processors - or independently determine the purposes and methods of their processing - controllers.
   1. Processing entities - the Administrator uses suppliers who process personal data only at the Administrator's request and these include, among others, providers of hosting or ICT services, accounting services, providing marketing systems, systems for analyzing traffic in the Online Store, systems for analyzing the effectiveness of marketing campaigns, companies performing marketing campaigns, software servicing companies.
   2. Administrators - The Administrator also uses suppliers who do not act solely on its instructions and determine the purposes and methods of using Customers' personal data themselves. They provide electronic payment services and banking services.
2. Location - Service providers are based in Poland and other countries of the European Economic Area (EEA).
3. Customers' personal data are stored:
   1. If the basis for the processing of personal data is consent, the Customer's personal data are processed by the Administrator until the consent is revoked. After its revocation, personal data are stored for a period corresponding to the limitation period for claims that may be raised by the Administrator and that may be raised against him. Unless a specific provision provides otherwise, the limitation period is 10 years, and for claims for periodic benefits and claims related to running a business activity, 3 years.
   2. If the basis for data processing is the performance of a contract, the Customer's personal data are processed by the Administrator for as long as it is necessary to perform the contract. After this time, personal data is processed for a period corresponding to the limitation period for claims. Unless specific provisions provide otherwise, the limitation period is 10 years, for claims for periodic benefits and claims related to running a business activity - 3 years.
4. When making a purchase in the Online Store, personal data may be transferred, depending on the Customer's choice, to the following entities in order to deliver the products ordered in the Online Store: (please list your suppliers and courier companies here)

   2. InPost Paczkomaty Sp. z o. o. based in Kraków, providing delivery services and operating the Paczkomaty post office box system.
5. A cash on delivery payment system, bank transfer or bank transfer is possible when selecting the Transferuj.pl payment system. 6. Personal navigation data may be used to provide Customers with better service, analyze statistical data and adapt the Online Store to Customers' preferences and to administer the Online Store.
7. If the Customer chooses the Newsletter subscription service, the Administrator will send information to his e-mail address or SMS messages to his mobile phone, containing commercial information about promotions, discounts, new products available in his Online Store.
8. If a request is made to the Administrator to share data, he will make personal data available to authorized state authorities, in particular organizational units of the Prosecutor's Office, the Police, the President of the Personal Data Protection Office, the President of the Office of Competition and Consumer Protection or the President of the Office of Electronic Communications
